Agreeing to these terms
These terms cover your use of the Portsmouth Concrete Works website and any estimate or job you book with us. If you use the site or hire us, you're agreeing to them, so please read them before you do.
Your signed estimate or contract is the main agreement for your job. If it says something different from this page, the contract wins for that job. You can get back to the start of the site anytime from our home page.
What we do
Portsmouth Concrete Works is a concrete contractor in Portsmouth, NH. We build driveways, patios, walkways, steps, garage floors, slabs, foundations, footings and retaining walls. We also do stamped and decorative work, concrete cutting and foundation raising for homes in Portsmouth and the cities around it.
This site describes our work in general. It isn't engineering advice, and it can't replace a look at your property. The work we'll actually do for you is the work written in your estimate or contract. You can read more about who we are on our about page.
Estimates and pricing
Estimates are free and done at your property, because we can't price a slab without seeing the ground, the slope and how a truck gets in. There's no pressure to book.
Your estimate lists the work, the price and how long that price holds. Concrete, steel and fuel costs change, so if you book after that date we may need to update the number before we schedule you.
Some things only show up once the old slab is out or the ground is open. Examples are soft or wet subgrade, which is the soil the new slab sits on, buried debris, ledge or big roots. If one of these changes the work, we'll stop, show you what we found and give you the added cost in writing. We don't do extra work without your OK.
Some concrete work needs a permit from the city where your house is. Your contract says who is responsible for it, and the building office in your city can tell you whether your job needs one.
Scheduling, weather and cancelling
We give you a start date when you book, but concrete depends on the weather. We won't pour in heavy rain or when it's cold enough to freeze, because water and frost ruin the top of fresh concrete. If we have to move your date, we'll tell you as soon as we know.
After the pour, the slab needs time to cure, which is the wait while it hardens and gains strength. We'll tell you when it's safe to walk on and when it's safe to drive on. Damage from using it before then isn't something we can cover.
If you need to cancel or move your date, call us as early as you can. Once concrete is ordered, materials are bought or forms are set, those costs may be charged as your contract says.
Payment
Your estimate or contract sets any deposit, when the balance is due and how you can pay. If you ask for changes after you sign, we'll put the change and its price in writing before we do it.
If a payment is late, we may pause work until it's settled. If a balance stays unpaid, we may use the remedies New Hampshire law allows to collect it, including collection costs where the law permits them.
Your part on the job
You agree to give our crew safe access to the work area and to keep kids and pets clear while we're working. Tell us where your property line is if there's any doubt, because we build where you show us.
Public utility markings don't show private lines like sprinkler pipes, pet fences, outdoor lighting or lines to a shed. Tell us where yours are before we dig. We aren't responsible for damage to buried lines we weren't told about.
A loaded concrete truck is heavy. We'll plan the route with you, but it can leave ruts in a lawn or crack an older driveway, curb or septic cover it crosses. Unless our crew was careless, we aren't responsible for that kind of damage along the route you approved.
Our guarantee and what it doesn't cover
We stand behind our work with our satisfaction guarantee. If something doesn't look right, call us and we'll come look at it. Any written warranty for your job is the one in your contract.
Concrete cracks, and no honest contractor can promise it won't. We cut control joints, which are grooves that give the slab a planned place to crack, so most cracks stay in the joints where you won't notice them. Hairline cracks, small color differences between pours and minor surface wear aren't defects.
Our guarantee doesn't cover damage from deicing salt or other chemicals, loads heavier than the slab was built for, frost heave or other ground movement, tree roots, drainage changes made by others, or work done by anyone else. Apart from our guarantee and anything written in your contract, we make no other promises about our work, stated or implied, to the extent the law allows.
Limits on what we're responsible for
To the extent the law allows, Portsmouth Concrete Works isn't liable for indirect losses tied to a job. That includes lost use of your driveway, lost income or delays caused by weather, suppliers or anything else outside our control. Our total responsibility for a job is limited to what you paid us for it.
The information on this site is general. We aren't responsible for decisions you make based only on what you read here without talking to us about your property.
If we disagree
Call us first. Most problems get sorted out with a visit and a straight conversation.
If we still can't agree, we both agree to try mediation before either of us goes to court. If it does go to court, the case will be heard in the courts of Rockingham County, New Hampshire, unless the law requires somewhere else.
Which state's law applies
These terms and your job with us are governed by New Hampshire law. If your property is in another state, like Maine, and that state's law has to apply to the work, it will.
Changes to these terms
We may update these terms from time to time and will post the new version on this page. The version in place when you sign your contract is the one that applies to your job.
If you have questions about anything here, call us at (603) 956-1034 or reach us through our contact page.
